"What do I do if others infringe my design rights?"

In this rubric, the basics regarding Intellectual Property will be explained. #YouAskWeAnswer. We have shifted our focus from trademarks to designs.

If anyone infringes your design right, then we will find a solution together. First, we will send the infringer a notice seeking to negotiate. If these efforts do not pay off, legal proceedings can be instigated.

In order to proceed on time, we advise you to:

  • Keep a close eye on the market and engage us at the earliest possible opportunity.
  • Take out our monitoring subscription, which means we can warn you if a similar EU Design is added to the register. We can also monitor the name of a particular company or designer on your behalf. You will then be informed about any new design registrations by that (legal) person. Annual subscriptions start at around € 150 per annum.
