In 2022 we started the NLO Academy to show our appreciation for our clients, in particular the in-house patent attorneys with whom we work closely together. The positive reactions we received for the previous editions of the NLO Academy encouraged us to organise this year’s edition. The event will cover the afternoon and will credit you with “3 PE points” and aims to provide you with new useful insights and the opportunity to participate in stimulating discussions with other patent attorneys.

  • 12:00 – 13:00 | Registration and lunch
     
  • 13:00 – 14:00 | Patenting Artificial Intelligence in life sciences
    Patenting Artificial Intelligence (AI) plays a role not only in IT itself but also in the fields of biotech / life sciences, chemistry, mechanics, etc. Harm van der Heijden (Dutch and European patent attorney at NLO) will discuss the possibilities and pitfalls from a patenting perspective, and highlight major differences between the large patent offices (e.g. EPO, USPTO).
     
  • 14:00 – 14:45 | EPO Enlarged Board of Appeal – Recent decisions and referrals
    Decisions G 1/22 and G 2/22 cause a dramatic shift in the assessment of formal priority. These decisions and their impact on the validity of the much debated CRISPR patents will be discussed by Willemijn Gommans (Dutch and European patent attorney at NLO).

    René van Duijvenbode (Dutch and European patent attorney at NLO) will address referral G 1/24, that seeks to answer to what extent the description, as well as Art. 69 EPC and its Protocol, may be used for interpretation of the claims when assessing patentability.

  • 15:15 – 16:15 | UPC: the first year of operation
    After a general introduction of the UPC by Marion Bruin (Dutch and European patent attorney at NLO), Gertjan Kuipers (IP lawyer at Hogan Lovells) will discuss the first UPC decisions that were issued on the merits. Differences and similarities between these UPC decisions and EPO case law will be addressed, as well as other intriguing aspects of this new court.
     
  • 16:15 – 17:00 | US Practice
    Tamara Stegmann (US patent agent, Dutch and European patent attorney at NLO) will show that the use of certain terminology may unintentionally limit a claim. Arguments made before the EPO may influence US proceedings, and Catherine Shultz (US and European patent attorney at NLO) will show us how to avoid the corresponding pitfalls.
